Mirat – Terms of Service

Welcome to Mirat, the Kurdish Royalty Collection Society. These Terms of Service (“Terms”) govern your use of Mirat’s services, website, and membership. By becoming a member, accessing our services, or using our platform, you agree to comply with and be bound by these Terms.
1. Definitions
- Mirat: Refers to Mirat Kurdish Royalty Collection Society.
- Member: Any individual, group, or organisation that has been accepted into Mirat and has signed a membership agreement.
- Work (s): Musical compositions, sound recordings, or any other creative output for which royalties are collected.
- Rights: Copyright, song and music rights
2. Membership Eligibility
To become a member of Mirat, you must:
- Be the legal owner or holder of rights to the works you register;
- Be at least 18 years old or have written consent from a legal guardian;
- Complete and sign the Mirat Membership Agreement.
- Provide proof of identity and rights ownership.
Mirat is open to all nationalities and languages.
3. Grant of Rights
By joining Mirat, you authorise us to:
- Collect, manage, and distribute royalties on your behalf for the rights you assign to us;
- Enforce your rights in any relevant jurisdiction, including taking legal action if needed;
- Sub-license your rights to partner societies or platforms for collection purposes.
This agreement is exclusive within the scope of your membership with Mirat is includes digital distribution, depending on your selections in the membership form.
4. Distribution of Royalties
- Mirat collects royalties from streaming services, broadcasters, and international partners.
- Royalties are distributed to members based on reported usage and our internal distribution rules.
- Mirat deducts an administration fee (disclosed in your membership agreement) to cover operational costs.
- Distributions are made quarterly, unless otherwise specified.
Note: Unallocated or unmatched royalties may be held temporarily and distributed based on reconciliation or best-practice methodologies.
5. Obligations of Members
As a member, you agree to:
- Provide accurate and up-to-date metadata about your works.
- Inform Mirat of any changes in rights ownership or contact information;
- Not double-register the same rights with another society for the same territory unless part of an approved multi-society agreement;
- Comply with applicable copyright laws and not infringe on the rights of others.
6. Term and Termination
- Membership continues until terminated by either party with written notice.
- Members may terminate their agreement with Mirat by giving 6 months notice, depending on the agreement terms.
- Mirat may terminate the agreement in cases of fraud, rights misrepresentation, or repeated breach of the Terms.
After termination, Mirat may continue collecting royalties for a limited period for previously used works to ensure final payments.
7. Liability and Limitation
- Mirat acts as an agent and does not guarantee the collection of all royalties from all regions or platforms.
- Mirat is not liable for indirect or consequential losses, unless caused by gross negligence or fraud.
- Our services are provided “as is” without warranties unless expressly stated.
8. Privacy and Data Use
Your data is collected and processed in accordance with our [Privacy Policy]. This includes data for identification, rights management, reporting, and communication purposes.
9. Amendments to Terms
Mirat may update these Terms from time to time. Members will be notified in advance of any substantial changes. Continued use of services after changes implies agreement to the revised Terms.
10. Governing Law and Disputes
These Terms are governed by the laws of the Kurdistan Region in Iraq, based on international copyright law. Disputes should first be attempted to be resolved through mediation or arbitration.
